Terms of Use
In short
- Your photos and videos are yours. We claim no rights to them.
- Purchases are made and refunded through Apple.
- Fonder is provided as it is, and we do our best to keep it working well.
Agreement
These terms apply to your use of the Fonder app for iPhone (“Fonder”, “the app”), made by an independent developer, Trung Hai (“we”). By downloading or using Fonder you agree to them. Your use is also subject to Apple's Licensed Application End User License Agreement. Where the two differ, these terms apply to the extent the law allows.
Your licence
We grant you a personal, non-exclusive, non-transferable licence to use Fonder on Apple devices you own or control, as allowed by the App Store's usage rules. You may not copy, modify, reverse-engineer, resell or redistribute the app, its films, recipes, sample images or artwork, except where the law expressly allows it.
Your photos, videos and recipes
- Ownership: everything you capture or create with Fonder belongs to you. You may use it for any purpose, personal or commercial.
- Where it's kept: your photos and videos are kept on your device (see the Privacy Policy). You're responsible for keeping your own backups. Deleting the app deletes what is stored inside it.
- Recipes you share: when you share a recipe, you let the people you send it to use it in Fonder.
Purchases
Some films, recipes and features need the one-time in-app purchase, “Unlock everything”. Apple sells the purchase and handles payment, restoring on your other devices, and refunds, under Apple's terms. Paid content may be added, changed or improved over time. Recipes released after your purchase are included in it.
Beta versions
Pre-release versions offered through TestFlight may contain bugs, may lose data, and may change or stop working before release. Please keep copies of photos you care about when testing.
Acceptable use
Don't use Fonder to break the law or to infringe other people's rights, including their privacy. You're responsible for the photos and videos you take and share.
Disclaimer
Fonder is provided “as is” and “as available”. Film looks are artistic interpretations, not exact reproductions of any real film stock or camera. To the extent the law allows, we make no warranty that the app will be uninterrupted, error-free, or suitable for a particular purpose.
Limitation of liability
To the extent the law allows, we aren't liable for any indirect, incidental or consequential loss, or for loss of data, arising from your use of Fonder. Our total liability to you is limited to the amount you paid for the app in the twelve months before the claim. Nothing here limits rights you have under consumer law that can't be excluded.
Trademarks
Fonder and its film and recipe names are our own. Other product or brand names mentioned in the app (for example in an “Inspired by” note) belong to their owners and are used only to describe a look; Fonder isn't affiliated with or endorsed by them.
Changes and ending
We may update these terms. The effective date above will change, and continuing to use the app after an update means you accept it. You can stop using Fonder at any time by deleting it.
